Fucking Glorious

Indiana and Arkansas took steps this week to quell the national uproar over their religious "freedom" laws. In short, they caved to the will of the free market.

And it was fucking glorious.

The revised Indiana law prohibits service providers from using it as a legal defense for refusing to provide goods, services, facilities or accommodations. It also bars discrimination based on race, color, religion, ancestry, age, national origin, disability, sex, sexual orientation, gender identity or U.S. military service.

You can almost here the slumped soldiers now that they can't refuse the gays anymore.

Arkansas was able to avert much of the fallout Indiana has seen by making changes before Hutchinson signed the law. The revised language more closely mirrors the 1993 federal law and only addresses actions by the government, not by businesses or individuals. 

People have focused on the call Governor Hutchinson got from Doug McMillon but consider the pressure Wal Mart is under from...well...US! My pals on the left like to squawk about corporate power but it has really been the people...the consumers that drive demand (that again?!? :)) that are putting the screws to these folks.

This whole affair was a massive statement on where we are at in 2015 in terms of civil rights. This country is not going to tolerate this bullshit anymore.

The Indiana Backpedal

Governor Mike Pence has caved.  He wants "clarification" legislation on his desk this week so there can be no mistake that Indiana SB 101 will allow discrimination against gays and lesbians.

So, once this gets all sorted out, how will businesses then be allowed to exercise their "religious freedom" if they view homosexuality as a sin? It seems to me that any clarification legislation will nullify the very goal of the law. Yet, conservatives are telling us that this was never the goal nor will it be so in the future. If this is the case, what was the goal?

Indiana A Go Go

Let the mad scramble to "explain" the new Indiana law begin!

I've watched with great amusement as conservatives in Indiana and across the nation have been falling all over themselves to reassure folks that their law does not allow discrimination against gay people. They've foamed at the mouth about "narratives" (code for "shit, we got caught with the truth again") and made false equivalencies to other laws which are supposedly the same thing. If they had only followed their own ideology of laws and unintended consequences, perhaps it might have turned out differently.

Instead, they passed a law to protect the thousands (see: absolutely fucking no one, misleading vividness) of people (see: Christians) being persecuted by the state (see: Obama...somehow) for their religious beliefs (see: making a cake for a gross gay couple) across Indiana. Didn't they realize that the free market (oh, hee hee hee ho ho...giggle fit complete with stomach grab) and the FIRST FUCKING AMENDMENT might not work in their favor?

Well, now Republican legislators are scrambling to add language to the bill that won't allow for discrimination against gays and lesbians. Shit...there goes the whole "I hate gays and won't serve 'em cuz my religion says so" point of this law!

AP has a nice summation of all of the latest, including this most excellent part.

Republican Senate President Pro Tem David Long stressed that the new law is based on the federal Religious Freedom Restoration Act of 1993, which has been upheld by courts. But the Human Rights Campaign said it's disingenuous to compare the two laws. 

The campaign's legal director, Sarah Warbelow, said the federal law was designed to ensure religious minorities were protected from laws passed by the federal government that might not have been intended to discriminate but had that effect. The Indiana law, she said, allows individuals to invoke government action even when the government is not a party to a lawsuit. It also allows all businesses to assert religious beliefs regardless of whether they are actually religious organizations.

Fine Tuning the Gay-Dar

Indiana passed a law this week allowing business to refuse customers due to religious objections. Essentially this means that if a business owner sniffs out the gay on someone, the state won't be allowed to compel them to serve said sinner.

There are a number of profoundly stupid things about this law and we are now seeing the fallout. Businesses are scrambling for "We Serve Everyone" stickers. Angie's list is cancelling their plans to expand into Indiana. The NCAA is reconsidering its place in Indianapolis and for future Final Four events. Indiana tourism are worried that the 4.4 billion dollar a year/75,000 jobs industry is going to be hit. Even Indiana businesses, the ones that conservative ideologues in the state are saying they are "protecting" are in full on pants shitting mode.

But the one thing I can't figure out is this. How can someone who is one of these "religious freedom riders" tell if someone is gay who enters their store? Men carrying photos of themselves with a vagina? :)

Arizona Gaydar

Arizona passed legislation Thursday that would allow businesses the right to refuse service that violates their religious beliefs. The main intent of the law is to prevent the gays from gaying up "Christian" businesses with their fag germs. I'm wondering if these same businesses can refuse service to anyone now based on religious beliefs. In addition, how can they tell if someone is gay? Smell? Looks?

It will be interesting to see if Jan Brewer signs the bill. I get that Arizona has a lot of frightened old people that are becoming more irrational by the minute but this law seems preposterous. I think the most detrimental effect will be on the economy of Arizona. Why are gay people's money less green than straight people's money?

Michael Sam Is An American Hero

Missouri defensive end Michael Sam told The New York Times and ESPN he is gay, and the 2014 NFL Draft prospect plans to become the first openly gay player in the NFL. Sam figures to be one of the top defensive draft picks this year. I was born in Columbia, Missouri and have been a Tiger fan since birth so his honesty makes me very proud indeed.

Some are saying that Sam has diminished his chances from being picked high in the draft but I don't. The people that run teams in the NFL want to win. Period. If Sam is a good player, he will get picked and it looks like he is top notch. He ranks among the top pass rushers in the SEC last year with 10.5 regular-season sacks (he had another one in the Cotton Bowl), boosting his NFL draft stock despite his lack of size for the defensive end position (6-foot-2, 255 pounds). He was also voted Team MVP by his coaches and teammates this year who have known for the past five seasons that he is gay.

Make no mistake about it, though, this is a big deal and Michael Sam, like Jackie Robinson before him, is an American hero. The NFL's culture is notoriously anti-gay with the locker room stuck in the 1950s. Most people under the age of 30 won't give a shit about this but the older folks might get bunged up. It will be interesting to see what happens. For me, it's just another wonderful indicator of the progress we have made as culture.

Michael, good luck with your career. I know it will be a bloody magnificent one!

Stunning...

I Was An NFL Player Until I Was Fired By Two Cowards And A Bigot

Near the end of November, several teammates and I were walking into a specialist meeting with Coach Priefer. We were laughing over one of the recent articles I had written supporting same-sex marriage rights, and one of my teammates made a joking remark about me leading the Pride parade. As we sat down in our chairs, Mike Priefer, in one of the meanest voices I can ever recall hearing, said: "We should round up all the gays, send them to an island, and then nuke it until it glows." The room grew intensely quiet, and none of the players said a word for the rest of the meeting.

What to do with people like Mike Priefer? I try to be tolerant but there is so much anger, fear and hatred with people like him. "We should round up all the gays, send them to an island, and then nuke it until it glows." ? This would be why I chuckle (and not because it's funny) when people like this bloviate about liberals being like Nazis. People like Priefer are the ones that really want to round up people and inter or execute them.

Honestly, there is no reasoning with the Priefers of the world. Interestingly, he's a great example of why I don't want to have guns banned in this country. If he decides to act on his beliefs, he'll need to be put down.

Once Again, The Adolescents

Dean Obeidallah put up a great piece after I had put up my take on the Phil Robertson flap. Much better points than I made...

Attention conservatives: you have the right to hate any group you want. Blacks, gays, Muslims, Jews, other sects of Christians, whoever you like. In fact, the U.S. Supreme Court has noted numerous times that the First Amendment guarantees “freedom of thought” in addition to freedoms such as religion and expression. Consequently, you can think as many hateful thoughts as you choose. 

But here’s the thing: if you voice those hateful views publicly, you will be held accountable. That’s called personal responsibility. You would think people on the right would be familiar with that concept since they idolize Ronald Reagan, who famously said, “It is time to restore the American precept that each individual is accountable for his actions.”

And words as well. But adolescents don't get this reality.

The First Amendment does not provide you immunity. It simply means that the government can’t prevent you from expressing yourself. But once you say something, you will be called to answer for it. This is the same reason Alec Baldwin was fired last month from his MSNBC show for making gay slurs. (Despite claims from the right, Alec Baldwin was indeed criticized publicly by GLADD for his comments.) And it’s the same reason Martin Bashir was pushed out at MSNBC for his horrible comments about Sarah Palin.

Interesting to read of Palin's reaction...

Never one to miss a chance for publicity, Sarah Palin posted on Facebook: “Free speech is an endangered species. Those ‘intolerants’ hatin’ and taking on the Duck Dynasty patriarch for voicing his personal opinion are taking on all of us.” (Only Palin could claim that a person who has just voiced intolerant comments like Robertson is being attacked by “intolerants.”) Of course, when Martin Bashir made despicable comments about Palin, she didn’t defend him by saying, “Free speech is an endangered species.” Nope, instead she slammed Bashir’s comments as being “vile” and “evil.” And officials at Palin’s political action committee demanded that MSNBC punish Bashir.

Again, adolescent...will they ever grow up?

I would like an answer to Obeidallah's question about the Right and their obsession with other people's anuses. Anyone?

Grounded Duck

I knew it wouldn't be long before one of the stars of A&E's Duck Dynasty spouted off some redneck bullshit about the gays. One of the show's stars, Phil Robertson, apparently didn't get the memo that we live in a tolerant society now and recognize that the Bible is wrong about some things, including homosexuality.

In an interview with GQ, Robertson said. "It seems like, to me, a vagina - as a man - would be more desirable than a man's anus. That's just me. I'm just thinking: There's more there! She's got more to offer. I mean, come on, dudes! You know what I'm saying? But hey, sin: It's not logical, my man. It's just not logical." Asked what, in his mind, is sinful, Robertson replied: "Start with homosexual behavior and just morph out from there. Bestiality, sleeping around with this woman and that woman and that woman and those men."

Right, because having sex with an animal is the same as two consenting adults...sheesh. A&E has suspended Robertson indefinitely as a result of these comments.

As expected, the right wing media industrial complex has rushed to his defense, citing "freedom of speech." The conundrum for them, however, is that corporations (see: Worship Immediately, no assembly required) are private entities and are free to hire and fire people based on their views. Now, if they suspended Robertson because he was white or heterosexual, then they might have cause for complaint. Or if they refused to provide him with service because he was a man, then we'd definitely have a civil rights violation on our hands. As it stands now, thought, the cries of freedom being taken away are full of sound and fury, signifying nothing.

I wonder if Robertson believes that women should be subservient to men as this directive is mentioned far more often than homsexuality...
